1) Definitions, characteristics, and applicable regulations

Cookies are small text files that websites visited by users send to their device (usually to the browser), where they are stored and then transmitted back to the website on subsequent visits.

Thanks to cookies, a website can remember a user’s actions and preferences (such as login details, selected language, font size, and other display settings), so that they do not need to be re-entered when the user returns to the site or navigates from one page to another. Cookies are therefore used to enable user authentication, session monitoring, facilitation of content use, and storage of information relating to users’ activities on a website. They may also contain a unique identification code that allows tracking of the user’s navigation within the website for statistical or advertising purposes.

a) Cookie classification

While browsing a website, users may receive cookies stored directly by the website they are visiting (so-called “first-party cookies”), as well as cookies set by websites or web servers other than the one being visited (so-called “third-party cookies”).
Some operations cannot be performed without the use of cookies, which in certain cases are therefore technically necessary for the proper functioning of the website.
Cookies can be classified according to their characteristics and functions and may remain stored on the user’s device for different periods of time:
– Session cookies (also known as navigation cookies), which are automatically deleted when the browser is closed;
– Persistent cookies, which remain stored on the user’s device until a predefined expiration date.
There are also analytics cookies, which are used to evaluate the effectiveness of an information society service, to design a website, or to measure website traffic, such as the number of visitors, possibly broken down by geographical area, time of connection, or other characteristics.
Under Italian law, the use of cookies does not always require the user’s explicit consent. In particular, consent is not required for so-called “technical cookies” (also referred to as “necessary cookies”), which are used solely to carry out the transmission of a communication over an electronic communications network, or strictly necessary to provide a service explicitly requested by the user. These cookies are essential for the proper functioning of the website or to perform activities requested by the user; without them, certain operations could not be carried out or would be more complex and/or less secure.

According to the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali), as set out in the Guidelines on cookies and other tracking tools of 10 June 2021 and subsequent clarifications (the “Guidelines”), the following also fall within the category of technical cookies and therefore do not require user consent:

  • Analytics cookies, provided that they prevent the direct identification of the user (so-called “single out”), thereby excluding analytics cookies that may act as direct and unique identifiers. Their configuration must allow reference to more than one device, creating reasonable uncertainty as to the user’s digital identity (typically through partial masking of the IP address, as indicated in the Guidelines). Furthermore, to qualify as technical cookies, analytics cookies must be used solely to produce aggregated statistics and must relate to a single website or mobile application, so as not to allow tracking of a user across different websites or applications;
  • Navigation or session cookies;
  • Functionality cookies, which allow users to navigate according to selected criteria (for example, language or selected products for purchase) in order to improve the service provided.

Conversely, for profiling cookies—that is, cookies used to create user profiles and to personalise services beyond what is strictly necessary, to send targeted advertising messages based on the user’s browsing preferences, or to analyse and monitor visitor behaviour—prior user consent is required.
